If policy changes are substantial Otium Lifestyle will notify all customers via e-mail. Please periodically review these Terms & Conditions for changes. Otium Lifestyle strongly recommends that you should seek medical advice before ordering fitness equipment, personal training sessions or health supplements to ensure that they are suitable for your health & fitness needs in conjunction with your current medical condition. It is entirely the responsibility of the customer to check and be aware of his or her own medical condition before using or purchasing any fitness equipment, personal training sessions or health supplements.
Otium Lifestyle reserves the right to alter prices to take into account forces beyond our control. Otium Lifestyle reserves the right to refuse to supply any person or company for any reason.
If any part of these Terms and Conditions are declared void for unfairness pursuant to the Unfair Terms in Consumer Contract Regulations 1999, the remaining contract shall only continue to bind the parties if it is capable of continuing in existence without the unfair terms.
Please note the customer's order constitutes an offer to buy the goods or services and is not a contarct of sale.
Otium Lifestyle Ltd shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and monies have been set aside on your credit card. Please note that prices can increase as well as decrease.
In the event that a product is listed at an incorrect price due to human or technical error, Otium Lifestle Ltd shall have the right to refuse or cancel any orders placed for products or services listed at the incorrect price.
Please note that only one promotional code or other discount can be used per order, and not in conjunction with any other offers (including products marked as 'special offer').
All products are subject to availability. Any orders including a product that is not in stock will automatically be placed on backorder. In most cases these products will be on order from the manufacturers. Otium Lifestyle will advise you of an estimated delivery date whereupon you may decide whether or not you would like to proceed with the order.
If for any reason we determine that a backordered item will no longer be available we will notify you immediately by e-mail, post or telephone whereby you will be able to select an alternative product or you will be able to cancel the order & get a full refund.
All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the Products ordered plus delivery charges and any other charges as set out in the 'Delivery Costs' section. Some items may incur extra charges because of the item being particularly heavy or being subject to an installation charge. Wherever possible we have made every effort to highlight these items. However, before your order is confirmed and accepted, we may contact you to inform you of any further charges.
We have three methods for you to place your order! Telephone, Mail, and Internet.
All orders must be paid for in full before they will be shipped or ordered from the supplier. This includes any item that is put on backorder for you because it is out of stock.
Payment is necessary so that we can allocate the incoming stock to your order. If you do not wish for payment to be taken for backorder items, we will be able to leave the item on back order for you, but we cannot guarantee that there will be free stock available to fulfil your order.
INTERNET ORDERS
Billing is initiated immediately when the order is placed whereby the charge will be authorised and debited to your card simultaneously. Otium Lifestyle does not store any payment details. The charge to your debit card or credit card will be shown on your statement as “Otium Lifestyle Limited”.
Credit Card Orders
If you are ordering by credit card the goods must be sent to the cardholders registered address. If you require the goods to be sent to another address (i.e. a work address) you must telephone Otium Lifestyle before placing the order and provide additional written documentation.
TELEPHONE ORDERS
Telephone orders can be placed Monday to Friday 9.00am to 6.00pm, Have your order and credit card details ready. When placing your order by phone, you will be given an order number, which you need to keep for future reference.
MAIL ORDERS
If ordering by post or fax you must provide all relevant information (i.e. product code and description, name and address, postcode and contact telephone numbers). Please allow a minimum of 5 working days for clearance of personal cheques on top of normal delivery time.

Promotional, Discounts and Voucher redemption
One Voucher or Promotional Discount per person per campaign is allowed irrespective of the number of email addresses, Card Holder addresses or Delivery Addresses the individual may posses.
Otium Lifestyle Ltd maintains the right to refuse, and refund if relevant, (even following acceptance of an order) any transaction where, in its sole opinion, the customer / transacting party are achieving multiple discounts.
Gift Voucher redemption
Only one gift voucher per person can be redeemed per transaction. We cannot allow more than one gift voucher to be redeemed per transaction.
Partner and Affiliate links
Only one promotional discount per transaction is allowed. A discount link via a partner / affiliate network are not entitled to use any further voucher or promotional discounts.

Standard delivery:
• Monday to Friday during working hours.
• Within 7 - 10 working days from placing the order, if we take longer than 28 days we will issue you with a full refund if required.
• Any delivery times quoted by our sales team are estimates for guidance only, unless otherwise agreed.
Our carriers are unable to give specific times for delivery.
Please note delivery to Highlands & Islands is defined as those UK address with a postcode in the following range: PO30-41, BT, IM, TR21-25, GY1-9, JE, IV, KW, ZE, HS, KA27-28, PH19-44, PA20-88 and thus does not come under our standard UK Mainland Delivery service. Please select Highlands & Offshore delivery option.

Prices apply to UK mainland delivery only. If you live outside mainland UK, please call 01908 240900 for a quote. For orders totalling £99.99 or under, delivery charges stand at £6.95. For orders over £100.00, delivery is free for order under 30kg. For orders that are deemed as heavy goods, or that are made to your specifications (see in the full description), please call 01908 240900 as extra costs will apply. Orders placed online, regardless of this request to call, will not be accepted.
RESTRICTED ACCESS
Due to the size of some delivery vehicles, Otium Lifestyle Ltd or any carriers delivering on behalf of us MUST be informed of ANY restrictions regarding access for the delivering vehicles. This includes but not limited to, steps (including those required to climb to gain access to the property entrance), any overhanging/low trees/shrubs, steep driveways, narrow lanes, tight bends or any other restrictions that may make it difficult for the delivering vehicle to gain access to the point of delivery. Otium Lifestyle Ltd will not accept any claims for compensation arising from non/failed/refused delivery of any item where the carriers or we were not made aware of any points regarding access restrictions. In the event that the item is refused/cancelled due to these restrictions, the customer is liable for all carriage charges & a 15% re-stocking fee will be applied.
The freight delivery service you receive may vary among carrier companies. Since most carriers deliver to the curb side immediately adjacent to their vehicle and regard inside delivery as an extra service cost, it may be necessary for you to assist or move merchandise into your home, this is especially relevant if you live in a block of flats as carriers will only deliver to the ground floor entrance to the block. If you have alternative delivery requirements, please contact Otium Lifestyle Ltd. Please ensure you include one or two phone numbers in case the carrier needs to notify you to arrange delivery.
Request For Specefic Delivery Date Orders
It may be possible to request delivery for a specific date. Otium Lifestyle Ltd will endeavour to make this happen but it cannot be guaranteed. Otium Lifestyle Ltd will not entertain any claim whatsoever for compensation arising from late delivery due to a third party carrier.
REFUSED DELIVERIES
If it is found that any of the larger products upon delivery 'will not fit' through any doors/stairwells etc and the product is subsequently returned/refused, you are responsible for all outward & return carriage costs incurred by Otium Lifestyle Ltd & a 15% restocking fee is applicable. Please also see 'Restricted Access' terms. We would therefore recommend that you ensure the product will fit and can be transported to its ground floor point of installation easily. If you need to confirm the boxed dimensions of a product please call Bodypower Sports Plc prior to placing your order.
LATE DELIVERIES
We or our carriers will always try to arrive on time, but will not be held responsible for late arrival due to unforeseen circumstances.
SHORT DELIVERIES & DAMAGE TO PACKAGING
When the delivering carrier brings your order you MUST count the pieces you receive & look for any damage to the packaging. It is noted on the carrier’s delivery note, the number of boxes you should receive. If the number of boxes you receive does not exactly match the number of pieces on the carrier’s delivery note, you MUST note the number of pieces you received on the delivery note by your signature. Damage to packaging MUST be noted on the delivery note next to your signature. You must cross out “delivered in good condition” from the carrier’s delivery note. It is very important to check your order. A signature is an acceptance that you have received the whole order & that the packaging was in good condition.
Any short delivery of boxes must be reported to Otium Lifestyle within 48 hours of signing. Neither Otium Lifestyle Ltd nor the delivering carrier can be held responsible for short deliveries or damages to packaging if you do not note them on your delivery note. This does not affect your statutory rights in the event of the goods being faulty.
The customer is asked to examine the goods as soon as reasonably possible after delivery & notify us of any fault or damage as soon as reasonably possible
Distance Selling
Otium Lifestyle abides by the distance selling regulations laid down by The Consumer Protection (Distance Selling) Regulations 2000. A summary of which can be found at the DTI's web site www.dti.gov.uk Under the Distance Selling regulations you have a right to cancel your order prior to shipment, see cancellation terms below, for any item purchased on this website for a full refund.
Cancellation
You may cancel your order by informing us of this in writing to the address or by email any time up to seven days from the day after the day of delivery. Goods are to be returned to us at your expense in an unused, unopened, condition without the seals or wrapping being removed or broken. Otium Lifestyle reserves the right to withhold a percentage of the refund value of returned goods if the product or packaging is in such a condition that the item needs to be reduced in price for resale.
Please note that your right to return Products does NOT apply to products that fall into the following categories:
• Goods made to your specification.
• Perishable goods (for example, food)
• CD, DVD, tapes or other recording media, software or videos if their seal is broken.
• Items such as PowerBreathe, heart rate monitors and boxing accessories cannot be accepted back due to hygiene reasons.
We will refund your money within 30 days of receipt of the goods or within 30 days of your cancellation, whichever is the earlier. Returned goods are to be accompanied by a note showing your name, the date of order and the order number, and should be forwarded to our Customer Service Department at the address below. If you do not pay for the goods to be returned to us a deduction will be made from your refund to cover our costs for collecting the goods.
Refused Delivery
If you refuse to accept delivery of your order for any reason other than the product being damaged in transit you will be liable for all outward and inward freight charges incurred by your refusal. If it is discovered that any of the larger products upon delivery do not fit through doors / stairwells and the product is subsequently refused you will be liable for all outward and inward freight charges incurred by Otium Lifestyle, plus a 15% re-stocking fee. We strongly recommend that you check the product size to ensure that the product will fit and can be transported to its point of installation easily. If you need to confirm boxed dimensions of a product please call Otium Lifestyle prior to placing your order.
Returns Policy
If you wish to return goods to Otium Lifestyle for a refund please contact us by phone/email/fax in the first instance. Remember that the parcel and the contents are your responsibility until they reach us. Our recommendation is that you send your parcel by registered post and that you retain proof of postage. The cost of returning goods is at your expense. This does not affect your statutory rights.
Provided the goods are in perfect condition, and in the original packaging, a full refund will be given on the product, excluding delivery charge.
Please note that should you order total have been over a £100.00 and thus meaning you did not incur a carriage charge. Any return of item(s) that subsequently brings your order total to below £100.00, will incur a retrospective and applicable carriage charge. This amount will be debited from your refund total.
Damaged or Faulty Products
Should you receive a damaged or faulty product item from us you should contact the Customer Services Department within three working days to advise of the damage / fault. On receipt of the damaged / faulty good we will offer you a choice of:
• A prompt replacement;
• A full refund; or
• An alternative item of the same value.
However, you must return the damaged or defective product and this must be received by us within 30 days of delivery to you. You will not be charged any additional shipping or handling fees for replacement shipments. In order to return the product please send the damaged or defective item by recorded delivery to the Customer Services Department with an explanation of the damage / fault, the cost of postage will be reimbursed. You should retain proof of postage.

All products on our web site & in our catalogues are covered by a manufacturers warranty. If you are using any of the products in an environment other than in a residential house you must check to see if the product you are purchasing has a warranty for the environment you are going to use it in. For example a product with a "home use" warranty will have no warranty whatsoever if used in a Full or Light Commercial environment. If you are unsure as to which classification of usage you require please ask & we will be happy to check if the products are suitable. No manufacturers warranty covers failure of a product if caused by unreasonable or abusive use or if the customer alters the product in any way or if the customer fails to provide reasonable & necessary care. Warranties also vary from manufacturer to manufacturer. If you require clarification of the terms for particular products we will be happy to supply these for you.
NON UK MAINLAND WARRANTIES
If you live outside the UK it is advisable that you check if the product you are wishing to purchase will have any warranty outside the UK.
Labour warranties for UK offshore postcodes may not be available. Please check before ordering. This is applicable to ALL offshore postcodes including Isle of Wight & Isle of Mann etc.
Some larger items come with optional assembly/installation. Further infomation with regards item's requiring assembly/installation can be found within the product description. Please note that installation costs vary from product to product. For those products which have the option to add the additional installation service; You simply need to 'click on' the tick box next to the product to 'Include installation'. The installation cost will then be added to your order total. For those products who's intstallation costs are included, this will also be displayed within the product description 'FREE INSTALLATION'.
We will always try to arrive on time, but will not be held responsible for late arrival due to unforeseen circumstances.
It is imperative that the space for the product/s has been cleared & that access is unrestricted. If the installer is unable to commence work due to the area not being cleared or access not being available at the agreed time Otium Lifestyle Ltd reserve the right to charge £25 for every half hour the installation engineer is unable to start work. We must be informed at the time of placing the order where the product/s are to be installed. All prices quoted are for ground floor installations in the main building of the property or a garage at side of the main part of the building. Installations above or below ground floor or outside the main building i.e. an outhouse etc may be subject to surcharge, especially if not mentioned at the time of order. You may be asked to assist the installer to get the product/s to their location, if no help is available then a 2 man installation may be required at extra cost.
Otium Lifestyle Ltd are within their rights to refuse any installation if the installer deems the installation location to be hazardous or the request unreasonable. If the product does not fit into the area where the installation is requested & a representative of Otium Lifestyle Ltd did not measure the area, then Otium Lifestyle Ltd cannot be held responsible, therefore the customer will incur the cost of the visit. Agreed installation times must be adhered too.
Adequate parking / vehicle access must be provided by the customer. Any charges incurred by the installer for parking etc will be chargeable. If the installation time is extended by there being inadequate parking / access then the extra time will also be chargeable at £50 per hour.
